Strategic Counseling
The Strategic Counseling attorneys at O'Melveny help clients develop legislative and political strategies on an array of public policy issues that run the spectrum from consumer privacy legislation to the privatization of governmental functions. Our attorneys, many of whom are Capitol Hill alumni, use their political experience to assist clients in drafting proposed legislation, hearing testimony, op-eds, fact sheets and other written materials. They also help our clients prepare for hearings with mock question-and-answer sessions and work with public relations professionals on coordinated strategies to achieve effective political results.
Representative Projects:
Class Action Fairness Act
Serving as the catalyst for class action reform, we proposed legislation expanding federal court jurisdiction over class actions. Firm researchers canvassed county courthouses nationwide to retrieve data for articles written by our lawyers, who also testified at more than a dozen House and Senate committee hearings. The White House and business groups rallied behind the idea and although opposition from the American Tort Lawyer Association was strong, on February 17, 2005, the Class Action Fairness Act (CAFA) was signed into law.
Major Insurance Company
We advised and represented a major insurance company that sought our strategic input on the Patients' Bill of Rights.
